Class Actions

Unpaid Wages / Overtime

Obtained a multi-million dollar class action settlement on behalf of employees forced to work "off-the-clock" for their employer. The employees, who earned an average of $35,000 a year, were not paid a regular or overtime wage for the additional hours of service.

Health Care Retirement Benefits

Secured an agreement from a corporation to restore retiree health care benefits. The company agreed to provide lifetime health care benefits to employees, but later reneged on the promise.

Unpaid Wages / Overtime

Represented a class of employees and obtained court-approved settlement for employer's failure to pay overtime. Employer erroneously classified every employee in its facility as exempt.

Unpaid Wages / Overtime

Successfully prosecuted a class action case against an international employer who had failed to provide its employees overtime. The seven-figure settlement secured recovery for employees who had been wrongly paid a salary, as well as for employees forced to work "off-the-clock".

Individual Claims

Breach of Contract

Won jury verdict for executive who had been fired in breach of his employment contract.

Gender Discrimination

Negotiated a large severance package, including favorable benefits, for a female sales executive at a large Fortune-50 company, prior to the commencement of litigation. Throughout her career, the company held our client to higher performance standards than her male counterparts. The higher standards also influenced lay-off decisions.

Breach of Contract / Gender Discrimination

Successfully settled a claim against a local college that terminated a high-level administrative employee in violation of the employee's contract. Prior to her termination, the employee also had suffered gender-based harassment on the job.

Defamation

On the eve of the trial, settled a teacher's defamation case. The employer implied the teacher engaged in inappropriate behavior with children. The claims originated from personal disagreements between our client and another employee at the school.

Race Discrimination

Successfully settled a reverse-race discrimination case for a while female employee who was unfairly demoted and replaced by an African-American employee. The client's settlement significantly exceeded her economic loss because of our ability to prove her emotional distress and explicate the employer's outrageous conduct.

Employment Benefits

Secured long-term disability benefits for an employee who was terminated due to the effects of a medical condition.

Sexual Harassment

Obtained a large settlement shortly after filing a complaint on behalf of a male employee who had been subject to racial and sexual harassment by other male employees.

Breach of Contract / Shareholder Protection

Successfully represented a client who suffered discrimination by his employer, a manufacturing company. The client was both the president and a minority shareholder of the company. The settlement, which included the buy out of our client's minority interest, was reached after commencing proceedings before the Equal Employment Opportunity Commission and prior to Federal Court litigation.

Breach of Contract

Negotiated a lucrative severance package, valued well over three quarters of $1 million, on behalf of a former company president, and settled a threatened breach of contract action against the employer.

Disability

Successfully prosecuted a disability discrimination claim before the Equal Employment Opportunity Commission and obtained an unconditional offer of reinstatement.

Wrongful Termination

Negotiated a severance package on behalf of a bank executive prior to commencing litigation. The employee was wrongfully terminated for alleged sexual harassment.

Sexual Harassment

Prior to litigation, negotiated a large settlement on behalf of a female employee who had been pressured by her supervisor into having sexual relations. The supervisor had indicated to our client that her job was in jeopardy if she did not consent.

Gender Discrimination

Litigated, and ultimately resolved a gender discrimination claim by a female executive at a local high-technology start-up company. Company management had a pattern of making comments that disparaged women and of replacing terminated female employees with less-qualified male employees.
